Home and Community-Based Services (HCBS) Quality Measure Set Measure Summaries

Use of the Home and Community-Based Services (HCBS) Quality Measure Set Measure Summaries indicates acceptance of the following license agreements.

FOR CENTERS FOR MEDICARE & MEDICAID SERVICES (CMS) MEASURES:

Any questions pertaining to the license or use of measures in the HCBS Quality Measure Set should be addressed to their respective measure stewards. End Users do not act for or on behalf of the CMS. CMS will not be liable for any claims attributed to any errors, omissions, or other inaccuracies in the information or materials contained on this page. In no event shall CMS be liable for direct, indirect, special, incidental, or consequential damages arising out of the use of such information or material.

FOR ADVANCING STATES AND HUMAN SERVICES RESEARCH INSTITUTE (HSRI) MEASURES:

ADvancing States® is a registered trademark of ADvancing States, Inc. (ADvancing States).   NCI® and National Core Indicators® are registered trademarks of the National Association of State Directors of Developmental Disabilities Services (NASDDDS) and the HSRI.  NCI State of the Workforce™ is a trademark owned by NASDDDS, HSRI, and ADvancing States.  NCI-AD™ is a trademark owned by NASDDDS, HSRI and ADvancing States.   The NCI measures, specifications, and surveys were developed by and are owned by NASDDDS and HSRI and used under license by ADvancing States.  All third parties interested in using any of these parties’ trademarks and/or copyrights, whether in whole or in part, for promotional or commercial purposes (on web sites, products, product packaging, promotional/advertising materials, etc.) must obtain the parties’ prior written consent accordingly.  Absent such prior written consent, any such third party promotional or commercial use may constitute trademark infringement, copyright infringement and/or unfair competition in violation of state and federal laws. ADvancing States, NASDDDS, and HSRI have no liability to anyone who relies on the trademarks, NCI measures, specifications, surveys or data reflective of performance thereunder.

FOR NASDDDS AND HSRI MEASURES:

NCI® and National Core Indicators® are registered trademarks of the NASDDDS and HSRI. The NCI-IDD measures and specifications were developed by and are owned by the NASDDDS and HSRI. NASDDDS and HSRI hold a copyright on all materials associated with the NCI-IDD measures and specifications and may rescind or alter these measures and specifications at any time. Users of the NCI-IDD measures and specifications shall not have the right to alter, enhance, or otherwise modify the NCI-IDD measures and specifications or associated materials. Anyone desiring to use or reproduce the contents of reports, inclusive of data results, without modification for a non-commercial purpose, may do so without obtaining approval from NCI-IDD. The use or reproduction of NCI-IDD survey instruments and questions requires prior approval by the NASDDDS and HSRI. All commercial uses or requests for alteration of the measures and specifications must be approved by NASDDDS/HSRI and are subject to a license at the discretion of NASDDDS/HSRI. NCI-IDD measures and specifications are not clinical or disability services guidelines, do not establish a standard of medical care, nor a standard for disability services and are not intended or tested for all potential applications.

The measures and specifications are provided “as is” without warranty of any kind. NASDDDS and HSRI make no representations, warranties, or endorsements about the suitability or utility of any product, test, or protocol identified as deriving from or based on an NCI-IDD measure or specification. NCI-IDD also makes no representations, warranties, or endorsements about the quality of any agency of a state, contractor of a state agency, or other organization who uses, applies, or reports NCI-IDD performance measures. NASDDDS/HSRI has no liability to anyone who relies on NCI-IDD measures and specifications or data reflective of performance under such measures and specifications.

FOR THE COUNCIL ON QUALITY AND LEADERSHIP (CQL) MEASURES:

Personal Outcome Measures® is a registered trademark of the Council on Quality and Leadership (CQL) and are owned by CQL. CQL also holds a copyright to these materials and may rescind or alter these materials at any time.

Users of Personal Outcome Measures (POM) shall not have the right to alter, enhance, or otherwise modify POM, and shall not disassemble, recompile, or reverse engineer POM. Anyone desiring to use or reproduce the materials without modification for the sole purpose of CMS HCBS Quality Measure Set reporting may do so without obtaining any approval from CQL. All other uses, including commercial use (including but not limited to vendors using the measures and specifications with a product or service to calculate measure results), must be approved by CQL and are subject to a license at the discretion of CQL.

POM are not clinical guidelines, do not establish a standard of medical care, and have not been tested for all potential applications. POM are provided “as is” without warranty of any kind. CQL makes no representations, warranties, or endorsements about the quality of any organization who uses or reports quality measures. CQL has no liability to anyone who relies on POM or data reflective of performance under POM.

FOR NATIONAL COMMITTEE FOR QUALITY ASSURANCE (NCQA) MEASURES:

NCQA measures and specifications are not clinical guidelines, do not establish a standard of medical care, and have not been tested for all potential applications. The measures and specifications are provided “as is” without warranty of any kind. NCQA makes no representations, warranties, or endorsements about the quality of any product, test, or protocol identified as numerator compliant or otherwise identified as meeting the requirements of an NCQA measure or specification. NCQA also makes no representations, warranties, or endorsements about the quality of any organization or clinician who uses or reports performance measures. NCQA has no liability to anyone who relies on NCQA measures and specifications or data reflective of performance under such measures and specifications.

No calculated measure rate based on Healthcare Effectiveness Data and Information Set (HEDIS) specifications may be called a HEDIS rate until it is audited and designated reportable by an NCQA-certified HEDIS auditor. Until such time, measure rates produced shall not be designated or referred to as a HEDIS rate or a HEDIS result for any purpose. Henceforth in this publication and in any other NCQA publication, “HEDIS measure” refers to the specifications and “HEDIS data/rate” refers to and assumes data or rate audited by an NCQA-certified auditor.

Limited proprietary coding is contained in the measure specifications for convenience. Users of the proprietary code sets should obtain all necessary licenses from the owners of these code sets. NCQA disclaims all liability for use or accuracy of any coding contained in the specifications.

The American Medical Association (AMA) holds a copyright to the Current Procedural Terminology (CPT) codes contained in the measure specifications.

The American Hospital Association (AHA) holds a copyright to the Uniform Billing (UB) Codes contained in the measure specifications. The UB Codes in the HEDIS specifications are included with the permission of the AHA. All uses of the UB Codes may require a license from the AHA. Specifically, anyone desiring to use the UB Codes in a commercial product to generate HEDIS results, or for any other commercial use, must obtain a commercial use license directly from the AHA.
