Section 1135 Flexibilities - South Dakota SUPPORT Act Section 1006(b) Communication (Third Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of South Dakota for multiple section 1135 flexibilities on March 24, 2020.  Your follow-up communication to CMS on January11, 2021, indicated South Dakota’s response to the COVID-19 pandemic has delayed its ability to submit a state plan amendment (SPA) to fulfill the requirements outlined in section 1006(b) of the Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment (SUPPORT) for Patients and Communities Act (“SUPPORT Act”).

CMS is approving this time-limited state plan amendment to respond to the COVID-19 national emergency. The purpose of this amendment is to cover pharmacy technicians, pharmacy interns and pharmacies under the Other Licensed Practitioner (OLP) benefit to administer COVID 19 vaccinations and reimburse administration of COVID-19 vaccines and treatments at 100 percent of Louisiana Region 99 Medicare rates.

CMS is approving this time-limited state plan amendment to respond to the COVID-19 national emergency. The purpose of this amendment is to add pharmacists, pharmacy interns, pharmacy technicians, and pharmacies as qualified providers of COVID-19 vaccinations and to implement reimbursement for the COVID-19 vaccine administration.

MI-20-0013

CMS is approving this time-limited state plan amendment to respond to the COVID-19 national emergency. The purpose of this amendment is to provide authority to address the National Emergency by providing Emergency Use Authority for investigational drugs, devices, and biological agents and their administration, as well as by increasing the payment for COVID-19 vaccine administration to 100% of the Medicare rate and by providing authority for an Alternative Payment Methodology to specific providers for COVID-19 vaccine administration.

IN-20-012-CHIP

This SPA amends Indiana’s previously approved Modified Adjusted Gross Income (MAGI) Methodology template by updating the budgeting methodology for accounting for reasonable and predictable changes in income. Specifically, the methodology will allow for prorating gross monthly income for temporary or seasonal employment.

Your follow-up communication to CMS on January 12, 2021 indicated Georgia’s response to the COVID-19 pandemic has delayed its ability to submit a state plan amendment (SPA) to fulfill the requirements outlined in section 1006(b) of the Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment (SUPPORT) for Patients and Communities Act (“SUPPORT Act”).

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of New York for multiple section 1135 flexibilities on March 26, 2020.  Your Disaster Relief SPA submission, Transmittal Number 20-0048, submitted on August 25, 2020, and follow-up communication on October 7, 2020, detailed an additional federal requirement that also poses issues or challenges for the health care delivery system in New York and requested a modification of an additional requirement.
