Effective January 27, 2021, this amendment brings the state into compliance with a court order that instructs the state to cover medically necessary Applied Behavior Analysis (ABA) therapy to treat Autism Spectrum Disorder (ASD) for Medicaid Managed Care Organization (MCO) clients over the age of twenty and removes the limitation for managed care and fee-for-service enrollees in the Applied Behavior Analysis (ABA) therapy to treat Autism Spectrum Disorder (ASD.)

Effective April 1, 2021, this amendment adds Electronic Visit Verification (EVV) compliance language and make technical language changes to update personal care benefits under the state plan. There are no changes to services and no impact to beneficiaries.

Section 1135 Waiver Flexibilities - Colorado Coronavirus Disease 2019 (Fourth Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of Colorado for multiple section 1135 flexibilities on March 26, 2020.  Your follow-up communication to CMS on February 19, 2021 detailed a number of additional federal requirements that also pose issues or challenges for the health care delivery system in Colorado and requested a waiver or modification of those additional requirements.

Section 1135 Waiver Flexibilities - Maine Coronavirus Disease 2019 (Fifth Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of Maine for multiple section 1135 flexibilities on April 7, 2020. Your follow-up communication to CMS on February 17, 2021 detailed a number of additional federal requirements that also pose issues or challenges for the health care delivery system in Maine and requested a waiver or modification of those additional requirements.

Section 1135 Waiver Flexibilities - Tennessee Coronavirus Disease 2019 (Third Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of Tennessee for multiple section 1135 flexibilities on March 31, 2020.  Your follow-up communication to CMS on March 29, 2021 indicated Tennessee’s response to the COVID-19 pandemic has delayed its ability to submit a state plan amendment (SPA) to fulfill the requirements outlined in section 1006(b) of the Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment (SUPPORT) for Patients and Communities Act (“SUPPORT Act”).

Effective January 24, 2021, this amendment continues Pennsylvania's authority to continue Medical Assistance Day One Incentive (MDOI) payments to nonpublic nursing facilities and sets the funding levels for Fiscal Year 2021.

OK-21-0016

Effective July 1, 2021 this amendment removes the 24-day per state fiscal year limit for covered inpatient physician and surgical services provided to adult SoonerCare members to align with current practices and for the purposes of the alternative benefit plan (ABP) for adults in the expansion group.
