Section 1135 Waiver Flexibilities - Georgia Requested on December 12, 2024

On September 23, 2024, the President of the United States issued a proclamation that 2024 Hurricane Helene constitutes an emergency by the authorities vested in the President by the Constitution and the laws of the United States, including sections 201 and 301 of the National Emergencies Act (50 U.S.C. 1601 et seq.), and consistent with section 1135 of the Social Security Act (the Act).

This amendment revises the distribution of Graduate Medical Education (GME) and Indirect Medical Education (IME) supplemental payments for the State Fiscal Year 2025.

This plan amendment makes rate year 2024 provisions for new and existing supplemental payments to ensure continued access to inpatient acute hospital services provided by qualified providers at risk due to the bankruptcy filed by Steward Health Care System LLC and its affiliates. It also makes technical edits to two quality incentive programs.

This plan amendment eliminates the requirement that the Department rebase nursing facility costs by July 1, 2024, and adds the requirement that the Department reimburse at least seventy-five per cent (75%) of the as-filed settlement pursuant to a facility's cost reports within ninety (90) days of receipt.
