This Amendment addresses the requirements regarding Estate Recovery per Section 115 of the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA) by encouraging dual eligible beneficiaries to fully utilize Medicare cost-sharing benefits available through the Medicare Savings Program.

This amendment allows the Georgia Medicaid program to establish programs to contract with one or more Medicaid RACs for the purpose of identifying underpayments and overpayments and recouping overpayments under the State Plan and under any waiver of the State Plan with respect to all services. All Medicaid RACs must be paid on a contingent basis for collecting overpayments.

This amendment makes the changes and clarifications necessary for Georgia to be responsive to the Department of Justice Settlement through the addition of new services and modifications to existing services.

This amendment specifically removes the Georgia Better Health Care (GBHC) program, the State's PCCM program from the state plan.

This amendment allows the Georgia Medicaid program to implement the Georgia SPA 12-001, Recovery Audit Contractors on April 1, 2012 in order to secure Medicaid Recovery Audit Contractors by this date.

This SPA was submitted to implement tobacco cessation counseling services for pregnant women as directed per State Medicaid Director letter (SMDL) 11-007.

The SPA changes the State of Georgia Executive Order designation from the Commissioner to the head of the Medicaid Agency.
