This time-limited state plan amendment responds to the COVID-19 national emergency. The purpose of this amendment is to provide flexibilities for presumptive eligibility, suspend all copayments, allow telehealth and provide an associated payment methodology, allow brand name products if generic prescription drugs are unavailable from the preferred drug list, and make interim payments to skilled nursing facilities.

Section 1135 Waiver Flexibilities - Virginia Coronavirus Disease 2019

The Centers for Medicare & Medicaid Services (CMS) is granting an initial approval to the state of Virginia for multiple Section 1135 flexibilities.  This approval letter replaces CMS’ March 23, 2020 approval letter.  Your communication to CMS on April 14, 2020 and updated on April 23, 2020 detai1ed a number of federal requirements that also pose issues or challenges for the health care delivery system in Virginia and requested a waiver or modification of these requirements.
