This time-limited state plan amendment responds to the COVID-19 national emergency. The purpose of this amendment is to provide for an extension of the reasonable opportunity period for non-citizens declaring to be in a satisfactory immigration status and to allow licensed practitioners practicing within their scope of practice such as nurse practitioners and physicians assistants, to order home health services.

Section 1135 Waiver Flexibilities - New Jersey Coronavirus Disease 2019 (Second & Third Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of New Jersey for multiple section 1135 flexibilities on March 23, 2020.  Your follow-up communication to CMS on April 29, 2020 and May 14, 2020 detailed a number of additional federal requirements that also pose issues or challenges for the health care delivery system in New Jersey and requested a waiver or modification of those additional requirements.

This time-limited state plan amendment responds to the COVID-19 national emergency. The purpose of this amendment is to authorize a supplemental payment of $20/day to nursing facilities. These payments will be retroactive to March 13 and will expire after 120 days or on the day the public health emergency ends, whichever occurs first.
