Section 1135 Waiver Flexibilities - Oregon Coronavirus Disease 2019 (April 17, 2020 COVID-19 1115 Application)

The Centers for Medicare & Medicaid Services (CMS) granted an approval to the State of Oregon for multiple section 1135 flexibilities on March 25, 2020; May 8, 2020; and August 20, 2020.  Your COVID-19 1115 application to CMS on April 17, 2020 detailed a number of federal requirements that pose issues or challenges for the health care delivery system in Oregon and requested approval of those additional components.

The State Plan has been amended to suspend all Episodes of Care, Asthma, Cholecystectomy (CHOLE), Chronic Obstructive Pulmonary Disease (COPD), Colonoscopy (COLON), Congestive Heart Failure (CHF), Coronary Arterial Bypass Graft (CABG), Perinatal, Tonsil, Total Joint Replacement (TJR), Upper Respiratory Infection-Non-Specific. Pharyngitis, Sinusitis (URI). Financially, the positive incentives (gain shai·e) now outweigh negative incentives (risk share).

CMS is approving this time-limited state plan amendment to respond to the COVID-19 national emergency. The purpose of this amendment is to make interim payments based on FFS utilization only to the fourteen (14) CMHCs that have had a decline in utilization due to the COVID-19 pandemic.
