Section 1135 Waiver Flexibilities - Nevada Coronavirus Disease 2019 (Second Request)

The Centers for Medicare & Medicaid Services (CMS) granted an initial approval to the State of Nevada for multiple section 1135 flexibilities on April 7, 2020. Your follow-up communication to CMS on December 15, 2020 detailed additional federal requirements that also pose issues or challenges for the health care delivery system in Nevada and requested a waiver or modification of those additional requirements.

Your follow-up communication to CMS on December 17, 2020 detailed additional federal requirements that also pose issues or challenges for the health care delivery system in Kentucky and requested a waiver or modification of those additional requirements.

CMS is approving this time-limited state plan amendment to respond to the COVID-19 national emergency. The purpose of this amendment is to begin reimbursing enrolled Hospitals and Critical Access Hospitals for the use of Medicare certified swing beds and to adjust certain inpatient rates to allow for increased reimbursements.

Adds greater clarification around operationalization of the HH programs, including new provider roles intended to increase overall quality improvement. In addition, the SPA broadened the scope of qualifying conditions to include chronic pain and chronic obstructive pulmonary disease, and made updates the reimbursement rates for the payment tiers assigned to the Chronic Condition HH program.
